Termination/access restriction
Historic Westside Village Festival reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Georgia and you hereby consent to the exclusive jurisdiction and venue of courts in Georgia in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Historic Westside Village Festival as a result of this agreement or use of the Site. Historic Westside Village Festival performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Historic Westside Village Festival right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Historic Westside Village Festival with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Historic Westside Village Festival with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Historic Westside Village Festival with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent an d subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms

REFUND POLICY
You bought vendor space or sponsorships, but things happen. Don't worry, we're here to help.
Canceled or Rescheduled Events
In either case, we'll alert you ASAP via the email address you provided during the purchase.
Canceled Events
If your event was canceled, in most cases you won't need to do a thing: we'll inform you of the cancellation and refund the value of your vendor space or sponsorships, including all fees on the same payment method used for purchase.
Rescheduled Events
If your event was rescheduled, we'll contact you with the new date and time ASAP via the email address you provided at purchase.
General Refund
Vendor space or sponsorships are non-refundable, unless the Festival has been cancelled.
Late Arrivals
Refunds are not provided for late arrival to an event.
WAIVER OF LIABILITY
Event Release & Waiver of Liability
I understand that by purchasing vendor space or sponsorships for this Event I will expose myself and my guests to the normal risks of injury or harm associated with nature, musical events, and social activities in general.
I hereby fully and forever release, discharge, and agree not to sue Historic Westside Village Festival, or any of its affiliates, employees, representatives, or successors for any and all claims, causes of action or liability for any injury, loss or damage sustained or incurred by me or my guests arising out of or in any way associated with our attendance at or participation in the Event.
I agree that this Event Release and Waiver of Liability shall be construed and interpreted according to the law of the state wherein the Event is conducted and that the release and agree that the waiver of liability herein will be construed to the maximum allowed by such law. I understand and agree that this Event Release and Waiver of Liability shall be binding upon my heirs, assigns and any personal entity acting upon my behalf.
I have read the above items of the Event Release and Waiver of Liability, understand them, agree to abide by them, and hereby acknowledge that I understand this Event Release and Waiver of Liability.
Historic Westside Village Festival does not provide liability insurance for the protection of individuals, groups, organizations, businesses, spectators, or others who may participate in the Historic Westside Village Festival Events.
In consideration for your participation in said Historic Westside Village Festival Events, the individual, group, organization, business, spectator, or other, does hereby release and forever discharge Stimulate America INC (Historic Westside Village Festival), and its officers, board, contractors, and employees, jointly and severally from any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury, which hereafter may be sustained by participating in the Historic Westside Village Festival Events.
This release extends and applies to, and also covers and includes, all unknown, unforeseen, unanticipated and unsuspected injuries, damages, loss and liability and the consequences thereof, as well as those now disclosed and known to exist. The provisions of any state, federal, local or territorial law or state providing substance that releases shall not extend to claims, demands, injuries, or damages which are known or unsuspected to exist at this time, to the person executing such release, are hereby expressly waived.
I hereby agree on behalf of my heirs, executors, administrators, and assigns, to indemnify Stimulate America INC (Historic Westside Village Festival) and its officers, board, contractors, and employees, joint and severally from any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury, which hereafter may be sustained by participating in the Historic Westside Village Festival Events.
It is further understood and agreed that said participation in the Historic Westside Village Festival Events is not to be construed as an admission of any liability and acceptance of assumption of responsibility by Stimulate America INC (Historic Westside Village Festival), its officers, board, contractors and employees, jointly and severally, for all damages and expenses for which Stimulate America INC (Historic Westside Village Festival), its officers, board, contractors, and employees, become liable as a result of any alleged act of the parade participant.
